However, with this new move, the company gained the attention of the local labor union representatives, who further decided to interact with the employees of the company. In this regard, they seek permission from Ms. Clark for their interaction with the employees, which they are not required to do so as they possess legal authority for performing the same. Owing to their professional approach, Ms. Clark permits the union representatives to enter the premises of the company for which she had to face criticism and threat of termination from the top level management of the company. This instance was followed by an offer from the management, which depicted a forceful retirement package with the exclusion of several normal retirement benefits. She did not response to the offer of the management, which eventually resulted in her termination. THESIS STATEMENT In context to the aforementioned case, this research paper will identify and explain the law that will be applicable to assist Ms. Clark to deal with the misconduct of the company made towards her. A few of the law that will be considered in this paper will include EIRSA (Title VII), the NLRB and Tort law of the United States among others. Accordingly, a conclusion will be made about the position of Ms. Clark in the entire scenario. DISCUSSION From the above analysis, it is quite apparent that Ms Clark had certain issues with her disability in Danskin Inc. However, the approach of the company made towards her with regard to promotion and decision of contacting the union representatives can be countered as per the EIRSA (Title VII), the NLRB and state Torts law in order to reach an ultimate conclusion on her rights and stands in the entire scenario. The Employee Retirement Income Security Act (ERISA) is a federal law of the United States, enacted in the year 1974 wit h the intention of protecting the rights of pension plan standards of the employees in the workplace. However, as per the Age Discrimination Employment Act (ADEA), employers should not discriminate the employees on grounds of their age and deprive them from gaining employment opportunities. Accordingly, the approach of the company in terms of not promoting Ms. Clark also has the association of her age factor as a reason. Furthermore, in this similar regard, Ms. Clark can also counter the approach made by the company towards her on the basis of the Americans with Disability Act (ADA) 1990, which states that employers will have the responsibility to treat all the employees on the basis of their competency and not their disability. In this case, Ms. Clark’s promotion was solely restrained on the basis of her legal blindness (Auburn University, â€Å"

The Call to Dinner Essay -- Art, George Agnew Reid

The Call to Dinner was painted from 1886 to 1887 by George Agnew Reid. The painting is an oil on canvas and is large scale, measuring 48 inches in height and 71 inches in length. Reid’s paintings were often large and it was said â€Å"one canvas could dominate a room crowded with people.† Early in his artistic career, Reid became known for his genre scenes. Genre painting depicts scenes from everyday life. In The Call to Dinner, the use of oil paint allows Reid to emphasize the principles of genre painting while permitting the enhancement of realism and naturalism within the composition. In oil painting, ground pigment is mixed with linseed or walnut oil. The oil creates a smooth sheen over the surface of the painting. Finished in 1887, it is most likely that linseed oil was used as a base for the pigment due to the limited amount of cracking seen today. The benefits presented by oil paint include a slow drying time, which allows for increased flexibility and subtly in colour mixing and blending. Also, oil paint can be applied thicker than other mediums, such as tempera. The focal point of the scene is the woman calling out into the distance. The subject of the painting appears to stand in arrested motion. The lips of the woman appear parted suggesting the action of speech. The woman is depicted wearing a greyish-blue dress, white apron, red scarf and a straw hat. The woman is holding the brim of her hat with her left hand, indicating the potential force of wind on the figures within the scene. Her hat is painted in fine detail. Reid uses short, thick brush strokes to imitate the weaves of the hat, creating realistic texture. The building up of consistent layers of oil paint creates the porcelain like texture of the woman’s s... ...n the painting is a darker tone of blue, whereas closer to the paintings linear horizon, the blue changes to a lighter, almost white hue. The formal properties of The Call to Dinner by George Agnew Reid contribute to the successfulness of the genre scene and assist in finding meaning within the painting. Through the benefits of oil paint, Reid is able to achieve a high level of realism and naturalism in The Call to Dinner. The versatility of the medium allows the artist to enhance all details and elements within a painting and present a realistic reflection of everyday life. Naturalism in movement is heightened by the medium’s ability to subtly blend. Textural elements, replicating the forms of reality, are created through the adaptability of oil on canvas. The formal properties of the medium allow the artist to shed light on a single moment in rural life.

John Locke’s theory about political power

John Locke's theory about political power is based on the idea of â€Å"perfect freedom†, a state everyone is â€Å"naturally in† while conducting personal proceedings and using possessions in normal way without pressing over or depending on other men. A law of nature governs the state of nature teaching that all people are â€Å"equal and independent† but they cannot hurt or destroy another person's â€Å"life, liberty, health or possessions†. God gives to his people different things to use for the best advantage of their lives but no one is born to has a domination over the other. There is a natural way in which a man can express the right to the things that are not beneficial to any other man yet. Then determination of property is given. Locke Justifies property as â€Å"the labor of his body and the work of his hands†. For the property to occur a person takes something from nature, mixes it with things that used to belong to him and adds his labo r. This individual labor is basically a main point from which exclusive right for the property starts and becomes unquestionable for the laborer as long as good enough is left for others.Every man is â€Å"lord† of his own. So, the only reason why man can give up his personal freedom and be bonded by political power of another man is his own consent and wish to unite with others into one mutually beneficial community. This community or government is considered to be safer, more comfortable and peaceful than life in his personal estate that could be endangered to â€Å"invasions of others†. The state of personal freedom is very unsafe and less enjoyable than secure life in society which is concerned about preservation of property.Tyranny is an â€Å"exercise of power beyond right†. It happens when anyone uses his r her power not for the best of others, but for the satisfaction of personal passions such as greediness, ambitions, wish to overpower others against th e law of nature. So, whenever such situation has occurred it has to be opposed because if the law is transgressed it causes harm to other people. Being rich or having an exceeding power is never a reason or an excuse â€Å"for rapine and oppression†.It doesn't matter if this man has a high or low rank, but for the king exceeding the authority is more shameful than for the constable because more trust is given to him. A king is also ell better educated and more acknowledged about right and wrong things to do which additionally obligates him. People willfully â€Å"choose and authorize a legislative† to create laws that will guarantee preservation of properties for each member in the community.People will never choose a legislative that makes laws being able to demolish things that everyone is trying to protect. When a legislative being ambitious or corrupted makes an attempt to go against â€Å"fundamental rule of the society† trying to enslave people, breaking t he trust at that moment his authority is ended. A new government which is ble to work for the protection of society should be chosen in case the old one bitrates the trust of people. Jefferson's text of the Declaration of Independence is mainly based on the ideas developed by Locke.Jefferson's â€Å"truth to be self evident† is basically the determination ot state ot nature in the work ot Locke. â€Å"All men are created equal† having certain rights, such as â€Å"life, liberty, and the pursuit of happiness†. Governments â€Å"are instituted among men† to protect these fundamental rights. In case the governor rules destructively over the people under his power he deserved nd should be thrown off his position and â€Å"new guards for future security† should be found.Jefferson writes the main part of Declaration describing that ruling of a present king of Great Britain is a history of â€Å"repeated injuries and usurpations†. â€Å"A prince w hose character is thus marked by every act which may define a tyrant is unfit to be the ruler of a free people†, he says. At this point a direct referral to the Locke's idea of perfect freedom is made. Using Locke's fundamental ideas in Declaration of Independence Jefferson Justifies separation of United States from England.

Reading Of The Digital Age Has The Internet Changed The...

Reading In The Digital Age: Has The Internet Changed The Way People Read? The Internet is, I believe, without a shadow of a doubt, one of the greatest resources the world has produced. One can get volumes and volumes of information in an instant. The information is available to anyone no matter where he or she is on the globe. Now one can work from home, in the car while on holiday, basically anywhere with an Internet connection. One can communicate with friends and interact with them no matter where they are. Social media, programs like Skype and other Internet based products enable people to communicate better from a distance. We are all getting to a certain point where we are online for so long that it has started affecting how we†¦show more content†¦They were convinced and adamant in their belief that the changes were because of the Internet. They had several reasons why they blamed the Internet for the changes and at the end of the interview; I let them enumerate the reasons. My first interviewee told me that he now found it harder to remember things. He kept forgetting simple things like dates, locations and products names. He found it harder to remember facts after just a short time. I tested it out during the interview and I witnessed him having to confirm facts from the Internet. I asked inquired why he was so sure that it was the Internet’s fault that he was having memory problems and he gave me several. The first one was that he never used to have that problem before. He says that in school he was pretty good at remembering things and he regularly won memory games. He said that he started experiencing the problems when he got into college and started relying on the net for his work and pleasure. He confessed that he did not go anywhere without his smartphone, tablet or laptop. He is always on his phone and most of the time he is surfing. He could not find another reason for his memory problems other than the Internet. After the interviews I went ahead and did some research for myself and see if it was possible that the Internet was to blame. Scientists have indeed found a connection between how we remember things and the Internet. They conducted research that indicated that people who

Meter and Rhythm Described in My Papas Waltz - 973 Words

My Papa s Waltz In Theodor Roethke s My Papa s waltz the reader finds a horrid experiance, the beating of a child by his father, which is told in a way of a romantic and beutifull dance - the waltz. The feeling one get from reading this poem is that the narrator, at least at the time in which the poem is written, does not look at this experience as something bad. He tries to beutify the experience by making it a waltz. He also, by means of images and rythem, shows the conflict between the readers, or the way any other normal man will look at this experiance, and how he sees it, or wants it to be seen ( although he does not show his father as completley innocent). It can also be looked upon as the Petty Herst syndrom -†¦show more content†¦One accusing finger does rise, and that is toward the mother, who Could not unfrown her countenance , as if the poet s mother does not react in order to maintain this or that frown that will leave her undignified , as if stopping his father from beating him is not of her duties - putting the blame away from his father. Another explanation, farfetched as it may sound, is that of the Petty Herst syndrom. The meaning of this syndrom is that one may enter into a state of life,a reality , that no matter how brutal or harsh it may be, once it is in his mind as an absolute reality, this reality will look as the most suitable reality, escape is not needable, and even when the person leaves this reality it will still, in retrospective, be the best situation he was ever been. It is possible that the narrator in this poem is afflicted by this syndrome. He defends his father because to him it seems that this is the reality he should be in. He describes the beatings as a waltz beacause he sees it as such. Although the poem is narrated retrospectively, from a grown up man point of view, something remains, the poet does not hate his father for the beating, on the contrary, he shows us that the love to his father is not, and never was lost. And twice during the poem - he talks about But I hung on in the first stanza, and Still clinging to your shirt. in the fourth stanza,Show MoreRelatedMy Papas Waltz Summary1072 Words   |  5 PagesIn Theodore Roethke’s â€Å"My Papa’s Waltz† the reader finds a horrid experience, the beating of a child by his father, which is told in a way of a romantic and beautiful dance – the waltz.
